This site is operated by the THE LANDER brand and is the official platform for the luxury apartment rental business offered by the company.
THE LANDER also allows its partner, the company KS MANAGEMENT (trade name Pick A Flat) Simplified Joint Stock Company with a capital of 3,000 euros Registered with the Paris Trade and Companies Register, under the number 797 829 298 having its head office located at 33 rue du Louvre — 75002, to exercise in its name the entire exploitation of the LANDER brand, of the platform www.thelander.com and any form of tenant search, and the provision of any service provided on behalf of the The Lander brand.
THE LANDER and its partner KS MANAGEMENT will be referred to below as THE LANDER.
The General Terms and Conditions of Sale (GTC) define the rules and procedures governing commercial transactions between THE LANDER or its partner KS MANAGEMENT and its customers on its online site. They establish the rights and obligations of each party, clarifying the conditions of reservation, payment, modification and cancellation, as well as the responsibilities in the event of a dispute.
These conditions apply to any adult person, referred to below as THE CUSTOMER, who makes a reservation on the website https://www.thelander.com.
The Terms and Conditions are made available to CUSTOMERS on the Site where they can be directly consulted and can also be communicated to them on request by any means.
The GTCS are enforceable against the CUSTOMER who recognizes, by ticking a box or by clicking on the button provided for this purpose, to have been aware of them and to have accepted them before placing an order.
ARTICLE 2 — RESERVATIONS
Booking process on the website:
Anyone of legal age can make an apartment reservation on the website https://www.thelander.com
A reservation is considered confirmed upon receipt of payment. By proceeding with the payment the CUSTOMER accepts the apartment and the rate offered for the period chosen.
A confirmation email will be sent to the address provided by the CUSTOMER when booking.
THE LANDER reserves the right to cancel any reservation considered suspicious or in the event of fraudulent or illicit payment.
Obligations and responsibilities of the CUSTOMER when booking:
The CUSTOMER guarantees that all the information provided during the reservation is accurate and true.
The CUSTOMER undertakes to make a reservation in his name and to be able to present his identity card as well as the bank card used for the reservation at any time before or during his stay at the simple request of THE LANDER.
The CUSTOMER must provide exact contact details on which he can be contacted by THE LANDER to organize his arrival at the apartment or if he needs to make contact during his stay.
The CUSTOMER undertakes to read and respect the internal regulations, explained below (see Internal Regulations) which must then be signed before the arrival of the Customer.
By confirming his reservation, the CUSTOMER acknowledges having had the opportunity to benefit from the advice and information necessary to ensure that the offer corresponds to his needs and to make his reservation in full knowledge of the facts.
ARTICLE 3 — PRICE AND PAYMENT
Price terms:
Before the CUSTOMER confirms their reservation, one or more rates, cancellation and payment policies are proposed and clearly displayed. By confirming the reservation, the CUSTOMER accepts the price and conditions displayed.
Whatever the cancellation policy, the principle is always the same, any amount collected is no longer refundable.
The total price of a reservation, unless otherwise specified, includes the cost of overnight stays in the apartment, daily cleaning service (optional but always included in the price), tourist tax as well as any other supplement selected by the CUSTOMER when creating the reservation.
It should be noted that the price may be subject to variations depending on various parameters such as the choice of the apartment, the dates of stay or the number of people concerned. THE LANDER uses dynamic pricing, which means that an apartment can change price at any time compared to a previous search.
In the event of a discrepancy between the number of people mentioned in the reservation and the actual number of people present, additional costs may be charged per person per night, up to the maximum number of people allowed in the apartment.
The price is expressed in EURO. In addition, it is important to note that any foreign currency conversion information displayed on the site is purely indicative. Thus, any costs relating to the exchange rate applied by the CLIENT's bank will be borne by the CUSTOMER.
It should be noted that the price indicated takes into account hotel value added tax (VAT), of 10%, excluding tourist taxes without VAT and applicable at the time of booking.
Booking and Deposit Payment Methods:
The site's payment page is connected to the secure STRIPE platform, which accepts the following cards: Visa, Mastercard, Amex, Maestro, Discover, JCB and Diners Club International. A secure 3DSecure payment is imperative on the platform.
If the CUSTOMER is unable to validate a payment on STRIPE, he can contact THE LANDER to potentially validate other forms of payment.
THE LANDER reserves the right to cancel any reservation considered suspicious or in the event of fraudulent or illicit payment.
The CUSTOMER undertakes to make a reservation in his name and to be able to present his identity card as well as the bank card used for the reservation at any time before or during his stay at the simple request of THE LANDER.
It should be noted that to make a reservation in one of THE LANDER apartments, the CUSTOMER must be able to provide a deposit by bank card via our service provider SWIKLY.
SWIKLY, neither charges nor blocks the CUSTOMER any euro. However, if the system does not work (depending on the customer's country), a deposit in the form of a transfer or in cash may be requested. THE LANDER reserves the right to refuse access to the booked apartment, without refund, if the deposit was not paid upon arrival.
In the event of damage found, THE LANDER reserves the right to charge all or part of the deposit to the SWIKLY partner relating to the amount of the damage.
In the event that the amount of the deposit is not sufficient, THE LANDER reserves the right to take any legal action against the CUSTOMER to request compensation.
ARTICLE 4 - CHANGES AND CANCELLATIONS
In accordance with article L.221-28 of the Consumer Code, after confirmation of the reservation, no right of withdrawal is possible.
Refund terms:
THE CUSTOMER has the option of selecting the cancellation and refund method that suits him when booking. Once payment for the reservation has been made, the selected cancellation method cannot be changed later.
For the non-refundable cancellation method, the CUSTOMER is required to pay the total amount of the reservation in order to confirm the reservation, this sum being final and not subject to reimbursement or modification.
The Semi-Flexible cancellation modality, the CUSTOMER is required to pay a 30% deposit at the time of confirming the reservation, which is not refundable. The remaining 70% must be paid no later than 30 days prior to the scheduled arrival date.
The reservation can be modified by THE LANDER at the CUSTOMER's request up to 30 days before the arrival date, subject to availability. It should be noted that THE LANDER reserves the right to refuse any request for modification of a reservation, without prejudice or obligation to justify.
Any modification of the date accepted by THE LANDER and resulting in a price difference greater than that initially agreed will be borne by the CUSTOMER. However, in the event that the new reservation has a lower price, no refund will be made.
In case of no-show by the CUSTOMER and in the absence of news from him, THE LANDER reserves the right to cancel his reservation without refund.
ARTICLE 5: COMPLIANCE WITH THE RULES OF THE ESTABLISHMENT
In the event of non-compliance with the internal regulations (below), the CLIENT may be held responsible for the total debit of his deposit, and THE LANDER reserves the right to initiate legal proceedings in order to be compensated. In addition, if the regulations are not respected, THE LANDER reserves the right to cancel the reservation at any time, without refund or compensation.
The use of THE LANDER apartments is strictly reserved for personal purposes, except with the prior written authorization of the managers.
It is strictly forbidden to carry out any paid activity in the apartments, under penalty of the reservation being cancelled and not refunded.
The CLIENT is authorized to take photographs of the apartment for personal purposes. However, it is expressly forbidden to use them for commercial purposes.
THE CUSTOMER is required to scrupulously respect the maximum capacity of the apartment, otherwise the reservation will be cancelled and not refunded.
THE CUSTOMER is required to respect the peace and quiet of the neighborhood. Any noisy or disruptive behavior that may cause a nuisance to neighbors is strictly prohibited.
The CUSTOMER is advised of the presence of a sound detector in the apartment, which will emit an alert in case of a noise level exceeding 70 decibels. If this threshold is exceeded, the security services will immediately contact the CUSTOMER by telephone. In the absence of improvement, security agents will be sent to put an end to the noise pollution. This violation could result in the cancellation of the reservation.
Pets are not allowed in THE LANDER apartments, unless agreed in advance.
THE LANDER reserves the right to access the apartment before 15:00 on the day of arrival, as well as in emergency situations requiring urgent intervention.
The apartment must be returned by 11:00am, unless previously authorized, on the last day of the reservation, in perfect condition. Any breach of this obligation exposes the CUSTOMER to be held responsible for any damage found.
ARTICLE 6 — RULES OF PROCEDURE
Check-In & Check-Out:
CUSTOMERS will receive a link to our registration web application, THE LANDER asks them to please answer it and fill in their information.
Arrival is after 15:00, THE LANDER will do its best to prepare the booked apartment as soon as possible if the GUEST arrives earlier.
The maximum departure time is 11:00.
House policy and respect for co-ownership:
The CUSTOMER undertakes to respect the following points during his stay:
THE CUSTOMER is asked to respect the apartment and the neighborhood. It is strictly forbidden to organize parties, to make noise or to put on music after 20:00.
Smoking is strictly forbidden in the apartment or in the common areas.
THE CUSTOMER is asked not to close the sofa bed with the duvet or cushions inside, as a result of which it could break.
THE CUSTOMER is asked not to leave rubbish in the yard or in the common areas. Waste disposal has been indicated in the house information.
The maximum departure time is 11:00.
It is strictly forbidden to steal anything from the apartment. THE LANDER checks every time the apartment is cleaned. Any theft will be taken very seriously and will be charged for stolen items in addition to a fee of 100 euros.
THE LANDER provides RITUALS beauty products as well as other THE LANDER branded products, with the exception of Vanity Sets and slippers, no product can be taken with the CUSTOMER upon departure, and will therefore be invoiced in the event of theft.
In the event of non-compliance with the rules, THE LANDER reserves the right to evict without notice, to charge all or part of the security deposit and/or to take legal action.
ARTICLE 7 — GENERAL RESPONSIBILITY
THE LANDER is not responsible for damage caused by third parties or for events beyond its control that occur in the apartments.
THE LANDER is not responsible for loss or material damage to CUSTOMERS' personal property in the apartments.
THE LANDER is not responsible for injuries resulting from the inappropriate or negligent use of equipment or installations in the apartments.
THE LANDER is not responsible for disturbances caused by renovation or maintenance work in buildings.
ARTICLE 8 - INTELLECTUAL PROPERTY RIGHTS ON THE CONTENT OF THE SITE
The entire site and its content are the exclusive property of THE LANDER.
THE LANDER owns the intellectual property rights to all elements on its website, such as design, images, text, videos, etc. This implies that any use, reproduction, distribution or modification of these elements without the prior authorization of THE LANDER constitutes a violation of its intellectual property rights and may result in legal proceedings. In other words, THE LANDER is the sole owner of the rights to its site and content, and any unauthorized use is strictly prohibited.
ARTICLE 9 — CUSTOMER PERSONAL DATA
CUSTOMERS' personal data collected by THE LANDER is processed in accordance with its privacy policy.
